Car Accident – The First 24 Hours. It’s a phrase nobody wants to think about, but being prepared before it happens could make all the difference. No one gets behind the wheel expecting to be in an accident, yet they happen every day. How you respond in the first 24 hours can have a direct impact on your safety, your legal standing, and the outcome of your insurance claim.

Most people know to exchange information and call the police. However, there is a lot more that goes into those critical hours. Knowing the right steps to take in advance could save you thousands of dollars and give you added peace of mind. Here is exactly what to do.

At The Scene of the accident

  • Check for injuries and move to safety
    • Before anything else, check yourself and your passengers for injuries. If it is safe to do so, move vehicle out of active traffic lanes. Turn on your vehicle hazard lights. If you have them, place road flares or reflective triangles behind your vehicle.
  • Call 911
    • Always call the police, even for a minor accident. An official police report is one of the most important documents for your insurance claim.
    • A police report can prevent future false claims from other parties as well.
  • Document everything at the scene
    • Use your phone to photograph all vehicles involved, the surrounding area, road conditions, traffic signs, and any visible injuries. The more photos, the better. You cannot go back and re-document the scene.
  • Exchange information – the right way
    • Get the other driver’s full name, phone number, insurance company and policy number, driver’s license number, license plate, and year/make/model of vehicle.
    • Also collect any contact information from witnesses at the scene.
Tip - Do not admit fault at the scene. Even something as simple as "I'm sorry" or "I didn't see you" can be used against you later. Stick to the facts when speaking to other drivers and the police. 

In the hours after an accident

  • Notify the insurance company promptly
    • Did you cause the accident? If so, you should contact your insurance company/agent ASAP to discuss the situation and file a claim if warranted.
    • If another party caused the accident and/or damage, you can contact their insurance to file a claim. This is effective the majority of time and allows you to potentially keep the claim off your driving record. However, some companies do not allow non policyholders to file claims. In that case, you should call your own insurance company and file the claim, even if you are not at fault.

  • Write down your account of what happened
    • While the details are fresh, write a narrative of the events. These include: what were you doing, the direction you were traveling, what you observed before impact, and the general sequence of events leading up to the accident. Remember memories fade quickly.
  • Be careful what you post of social media
    • Avoid posting anything on social media until after the claim is fully resolved and closed. Photos, comments, or even vague updates can be used by insurance adjusters and opposing attorney’s to dispute your claim and minimize your injuries.
